At Energy Africa Recruitment (EAR) we take the protection of your personal data seriously.

This South Africa Candidate Privacy Notice has been published in compliance with the Protection of Personal Information Act, 2013 (PoPIA).

In terms of PoPIA, Energy Africa Recruitment is a Responsible Party in that we are accountable for deciding how we collect, hold and use personal information about you.

As part of these obligations, we are required to provide you with information on how we use your personal information and the legal basis for using it, how we store it, how long we will retain it for, how we protect your personal information, your rights regarding the processing of this information, and who to contact should you need to enact any of those rights.

We are a recruitment agency with a focus on Renewable Energy related roles. We collect the personal information of the following types of people to allow us to undertake our business:

    • prospective and placed candidates for permanent and fixed-term roles
    • prospective and live client contracts
    • supplier contracts to support our services
    • employees (both fixed-term and permanent) and consultants

We collect information about you solely for the purposes of carrying out our core business and ancillary activities.

We will collect, process, and store your personal information in connection with your application for a job. We will use the following categories of personal information for individual applicants to do so:

    • Information provided by you in your CV
    • The information you have provided to us in our Credential assessment & consent form, which may include, name and surname, address, telephone number, email address, date of birth, Identity Number, gender and next of kin
    • Any information you provide us during an interview such as: salary expectations, current salary and any notice periods
    • Other information that is included as part of the process, which may include: psychometric test results or similar, and references (please note you are responsible for ensuring that these references are aware that you are sharing their personal information for these purposes)
    • To the extent, permitted and/ or required by applicable laws, we may collect, process and store special personal information, which is known as special personal information and submitted by you, which is detailed as follows:
    • Information about your race or ethnicity, religious belief, biological gender and political persuasions
    • Information about your health, including any medical condition, health and sickness records
    • Information about criminal convictions and offenses

If you are a corporate entity entering into an agreement with us for the purposes of supplying candidates for roles you may have available, we will process your company’s information (name, registration number, authorities appointed to act on behalf of the entity) on the basis of a contractual arrangement we have with you.

We will more than likely obtain further personal information about during the course of our relationship with you. More detail around or record retention will be detailed further in this notice.

We collect and retain information about you from the information you provide to us directly (when you sign up to use our services via our website) or that of a third party service, such as another recruiter.

Additional sources may include where you post comments on our social media pages or where we collect information from our website or social media platforms using cookies, web beacons and/or other technologies. Depending on how you access and use websites, we may receive: log information, information we infer about you based on your interaction with products and services, device information (for e.g.: what type of device you are using, how you access platforms, your browser or operating systems and you Internet Protocol (IP) address). We may also collect available information that is available about you publicly or commercially and combine it with information we have collected or received about you in other ways. This will be disclosed to you prior to it being sent through to a potential employer for application consideration and no decision will be made without you having the opportunity to object to the collected information. You may also request to view this or for the deletion of this via the methods discussed below in our Data Subject’s Rights section.

If you fail to provide information when requested, which is necessary for us to consider in your application (such as evidence of qualifications or work history), we will not be able to process your application successfully. For example, if we require a credit check or references for this role and you fail to provide us with the relevant details, we will not be able to take your application further.

We will collect, process and disclose your personal information for our legitimate business purposes, including:

    • to enable you to submit your CV through to us for job applications or to subscribe to job alerts
    • to match your details to existing or new vacancies that become available which will assist us in ensuring we find you a role that is most suitable for you
    • to retain your details and process them for future job vacancies that become available
    • to provide services to you
    • to manage our business relationship with you and with our corporate clients, where you are a user of our websites, a client or candidate

    • to fulfill contractual obligations with our clients
    • to provide further services to you by sharing your details with our trusted third parties or within our group of companies
    • to release personal information to law or regulatory enforcement bodies if we are required or permitted to do so

We apply equal rigor to the testing and the standard of our trusted third parties that we use whether they be local or cross-border. We ensure that the data security and protection is at an equal level to that which we uphold and meets the requirements of PoPIA or a that of a higher level if needed in terms of the applicable data protection legislation.

We are based and operate out of South Africa. Your personal information may be transferred to and maintained on servers located outside of your country of residence, where the data privacy laws may not be equivalent to the laws in your country of residence.

We may transfer your personal information to countries outside of South Africa and store it there where either we or our suppliers may process it. Should this happen, we will only transfer your personal information and store it in a country that has equivalent or better data protection legislation than South Africa or to a service provider that is subject to an agreement requiring it to comply with data protection rules equivalent or better than those in South Africa.

Your use of our website and submission of your personal information represents your consent to such transfer.

We will take all steps reasonable and necessary to ensure that your personal information is treated securely and in accordance with this privacy policy.

Energy Africa Recruitment will collect, use, store and otherwise process your Personal Information for the purposes of recruitment or resourcing activities. Under the PoPIA, the main grounds we rely upon in terms of processing your personal information of both clients and candidates, are the following

    • necessary for the entering into and performance of a contractual arrangement whereby we undertake to perform a service to you
    • necessary for the compliance with a legal obligation where we are subject to certain laws or legal requirements which may require us to process your personal information. We may further be obligated to disclose your personal data to a regulatory body or law enforcement agency
    • necessary for the purposes of legitimate interests- either we or a third party are required to process your personal information for the purposes of our/their legitimate interests. This is only done providing that we have established that those interests are not overridden by you rights and freedoms, including your right to the protection of your personal data. Our legitimate interests include, but are not limited to; responding to requests for information and enquiries from either you or a third party in response to our contractual arrangements, informing you about our products and services, optimizing our website or social media pages and customer experience and ensuring that we operate in an efficient and effective manner
    • consent- in some circumstances, we may ask for your consent to process your data in a certain way. Examples of where consent may be used as a legal basis for processing include permission to introduce you to a client (if you are a candidate) or if we need to process special categories of personal information. Should we want, need or rely on your consent to lawfully process your personal information, we will request this consent orally, or by email, or by an online process for the specific activity that we require consent for and record your response on our system. You will have the opportunity to withhold consent or to request to withdraw it any time though this may limit our ability to provide a full service to you

Updating your data

To optimize the chances of us proposing opportunities to you, and to ensure that we continually enhance our data quality, please inform us in writing of any changes to your address, your contact details and your situation in general. Any information withheld by you could prevent us from processing your file in optimal conditions

Your rights to access, discover, rectify and delete your personal data

However, we do employ a number of safeguards intended to mitigate the risk of unauthorized access or disclosure of your information. We will do our best to protect your personal information and we will use up to date technology that will help us to do this. We will at all times comply with our obligation under applicable law.
